A Quantitative Study of Investment Treaty Cases

ICSID Award Damages

We have studied the quantitative aspects of all ICSID merit awards through June 30, 2013. We found that reported claims have approached $23 billion with awards to date around $4.5 billion. Using our scoring system, the respondent won in nearly 80% of the cases. The claimants were awarded 100% of their claim in 9% of the cases. We have quantified the results of these cases for the most active arbitrators, law firms and damages experts.

We hope this first edition of our study will be a helpful tool for all the many players in the investment treaty field of international arbitration.
